Terms of Service
These Terms govern your access to and use of Pulse. Do not use Pulse if you do not agree to them.

Eligibility
Pulse is for adults only. You must be at least 18 years old and able to form a binding agreement to use Pulse. By using Pulse, you confirm that the account information you provide is accurate and that you will keep it current.
Accounts
You are responsible for activity on your account and for keeping your device, phone number, and authentication codes secure. You may not create accounts for others, impersonate another person, or use Pulse if we previously removed you for violating these Terms or our Community Guidelines.
License to Use Pulse
We grant you a limited, revocable, non-exclusive, non-transferable license to use the Pulse app and website for personal, non-commercial purposes in line with these Terms. Pulse and its software, design, branding, and other service content remain the property of John Park, doing business as Pulse. If you send us feedback or suggestions, we may use them without restriction or obligation to you.
User Content
You keep ownership of content you submit to Pulse. You grant Pulse a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, transmit, moderate, and otherwise use your content as needed to operate, improve, protect, and promote the service. You are responsible for having the rights to the content you post.
Copyright Complaints
If you believe content on Pulse infringes your copyright, email pulse-support@pulsegroups.app with: identification of the work and the infringing material, its location on Pulse, your contact information, a statement that you believe in good faith the use is unauthorized, a statement under penalty of perjury that your notice is accurate and you are the owner or authorized to act for the owner, and your physical or electronic signature. We remove infringing content and terminate the accounts of repeat infringers.
Acceptable Use
You may not use Pulse to:
- Harass, threaten, stalk, shame, exploit, or abuse another person.
- Post hate, sexual, violent, illegal, spam, scam, or unsafe meetup content.
- Share another person's private information or intimate images without consent.
- Misrepresent an activity, route, risk, identity, affiliation, or safety condition.
- Scrape, attack, reverse engineer, overload, or interfere with Pulse systems.
- Violate law, third-party rights, app-store rules, or connected-service terms.
Meetup Safety
Pulse helps people coordinate real-world athletic activities, but we do not verify every route, host, participant, weather condition, or safety claim. You are responsible for your own judgment, fitness, equipment, route planning, transportation, emergency planning, and decision to meet or train with others. Pulse is not an emergency service.
Assumption of Risk
Athletic activity and meeting people you do not know carry inherent risks, including injury, illness, property damage, traffic, terrain, weather, equipment failure, and the conduct of other participants. You participate in activities you find or organize through Pulse voluntarily and at your own risk, and to the maximum extent allowed by law you release John Park, doing business as Pulse from claims arising out of those risks.
Moderation and Enforcement
We may remove content, limit distribution, revoke share links, suspend accounts, delete accounts, block access, or contact law enforcement when we believe it is necessary to enforce these Terms, our Community Guidelines, law, or user safety. We may use automated and human review to detect prohibited content.
Termination
You can stop using Pulse at any time and delete your account in the app's settings. We may suspend or terminate your access as described in Moderation and Enforcement. Sections that by their nature should survive (including User Content licenses, Assumption of Risk, Disclaimers and Liability, Indemnification, and Disputes) survive termination.
Third-Party Services
Pulse integrates with third-party services such as Firebase, Cloudinary, Mapbox, Strava, Spotify, Apple, Google, race-result providers including Athlinks and UltraSignup, and hosting or monitoring providers. Their terms and privacy practices may also apply when you use those features.
App Store Terms
If you download Pulse from the Apple App Store or Google Play, these Terms are between you and John Park, doing business as Pulse, not Apple or Google. Apple and Google have no obligation to provide maintenance or support for the app and are not responsible for claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Disclaimers and Liability
Pulse is provided "as is" and "as available." To the maximum extent allowed by law, John Park, doing business as Pulse disclaims warranties and will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, goodwill, profits, or activity opportunities.
Indemnification
To the maximum extent allowed by law, you agree to indemnify and hold harmless John Park, doing business as Pulse from claims, damages, and expenses, including reasonable attorneys' fees, arising out of your content, your activities and meetups, your use of Pulse, or your violation of these Terms or of law.
Disputes
These Terms are governed by the laws of California, except for conflict-of-law rules. Before filing a claim, contact pulse-support@pulsegroups.app so we can try to resolve the dispute informally within 60 days.
If we cannot, you and Pulse agree to resolve disputes through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in California, instead of in court, except that either party may bring an individual claim in small claims court. You and Pulse each waive the right to a jury trial and to participate in a class action or other representative proceeding.
You may opt out of arbitration by emailing pulse-support@pulsegroups.app within 30 days of first accepting these Terms. If you opt out, or where arbitration does not apply, disputes will be handled in the state or federal courts located in California.
Changes to These Terms
We may update these Terms as Pulse changes. We will post the updated Terms here with a new "Last updated" date and, for material changes, notify you in the app. Continuing to use Pulse after changes take effect means you accept the updated Terms.
Miscellaneous
If part of these Terms is found unenforceable, the rest remains in effect. These Terms and the policies they reference are the entire agreement between you and Pulse about the service. Our not enforcing a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of the service.
